What you can build without a permit in Kentucky
By Mario Bailey Last checked · 20 official sources
Quick answer
Across the 2 Kentucky jurisdictions we have verified, 1 of 24 project rules need no permit at all, 10 turn on a size or scope condition the jurisdiction publishes, and 13 require a permit regardless. Bathroom remodel work is where the answer most often comes with a published condition rather than a flat yes: 2 of the 2 jurisdictions that answer publish one.
How to read this page
"No permit" means the jurisdiction publishes that the work needs no building permit. "Depends" means it publishes a size, height, depth, cost or scope condition that decides the answer, quoted in its own words in the last column; the number beside it is the figure that condition turns on, and which side of the number is exempt is stated by the condition, not by us. Exempt from a building permit is not exempt from zoning, setbacks, height limits, flood rules, an HOA, or a separate electrical, plumbing or mechanical permit, and several of the conditions below say exactly that.
Bathroom Remodel
All 2 make the bathroom remodel answer turn on a size or scope condition the jurisdiction publishes.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Lexington | Depends | LFUCG says most residential remodeling needs a building permit, naming structural work (creating, moving or removing walls) and adding a window or door as examples, and asks owners to call when unsure. | |
| Louisville | Depends | Louisville Metro lists new bathrooms among projects that need a building permit, and lists painting, tiling, carpeting, cabinets, countertops and other finish work among projects that do not. |
Fence
All 2 make the fence answer turn on a size or scope condition the jurisdiction publishes.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Lexington | Depends | 24 inches | height of fence or wall above grade. |
| Louisville | Depends | 7 feet | fence height (retaining walls: over 4 feet). |
Shed
All 2 make the shed answer turn on a size or scope condition the jurisdiction publishes, and the 2 that state a number all publish 200 sq ft.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Lexington | Depends | 200 sq ft | floor area of a detached accessory structure used solely for storage. |
| Louisville | Depends | 200 sq ft | floor area of the accessory structure. |
Deck
1 of 2 makes the deck answer turn on a size or scope condition the jurisdiction publishes. Lexington requires a permit for deck work regardless of size.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Louisville | Depends | 200 sq ft | area of a freestanding deck; an attached deck always needs a permit. |
| Lexington | Permit required | LFUCG treats a deck as an addition to a house, townhouse or duplex and requires a building permit before any construction, with no size or height exemption published. |
Plumbing
1 of 2 makes the plumbing answer turn on a size or scope condition the jurisdiction publishes. Louisville requires a permit for plumbing work regardless of size.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|

| Louisville | Permit required | Louisville Metro does not issue plumbing permits. |
Pool
1 of 2 makes the pool answer turn on a size or scope condition the jurisdiction publishes. Lexington requires a permit for pool work regardless of size.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Louisville | Depends | Louisville Metro requires a building permit for an in-ground pool, but says an above-ground pool does not require one. | |
| Lexington | Permit required | An in-ground swimming pool requires a Swimming Pool Permit from the Division of Building Inspection, and the Fayette County Health Department must approve it before the permit issues. |
Patio
Louisville requires no patio permit at all. 1 publishes no answer we could verify.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Louisville | No permit | Louisville Metro's only published statement on patios says a ground-level patio does not require a building permit; it appears in the pool guide, about a patio beside an in-ground pool. |

All 1 makes the roof replacement answer turn on a size or scope condition the jurisdiction publishes. 1 publishes no answer we could verify.
| Jurisdiction | Permit | Published figure | What the rule says |
|---|---|---|---|
| Louisville | Depends | Louisville Metro says reroofing does not require a building permit, so its office does no reroofing inspections. |
If the work is already built
Anyone who violates the Uniform State Building Code or the Uniform State Residential Code, or any order issued under them, faces a fine of $10 to $1,000, and each day the violation continues is a separate offense. For a single-family home, though, state law does not itself require a building permit: permits, inspections and certificates of occupancy are mandatory only where the local government has passed an ordinance or set up a building inspection program (KRS 198B.060(1) and (8)).
Kentucky penalties, the after-the-fact path, and what the statute actually says
2 of the 26 rules we hold for Kentucky are unresolved because the jurisdiction publishes no answer; they are counted nowhere above. The 24 answered rules come from 20 official sources, each linked from the permit page behind every jurisdiction name. See the full picture for the state on the Kentucky permit requirements page, or the national view of which projects need a permit at all on Do you need a building permit?
This page compiles what each Kentucky jurisdiction publishes, with a last checked date. It is not legal advice, and a project that is exempt from a building permit can still need zoning approval or a trade permit. Confirm with the office linked from the jurisdiction's page before you build.
